Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the ADA SafeCheck browser extension, the hosted scanning service and this website (together, the "Service"), provided by ADA Safe Check ("we", "us"). By installing the extension, creating a license, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What the Service is

The Service performs automated accessibility testing against WCAG 2.1 Level AA using the axe-core v4 rule engine. The free website check performs a limited structural examination of a page's HTML. The extension runs the full rule engine against the page you are viewing and can export a PDF report documenting the findings.

3. What the Service is not

Automated testing detects only a subset of accessibility requirements. The Service does not certify compliance with the ADA, Section 508, WCAG or any other standard, and it is not a substitute for manual review, keyboard and screen-reader testing, or professional advice. We are not a law firm and nothing produced by the Service is legal advice.

4. Eligibility and acceptable use

You must be at least 16 years old and able to enter into a binding contract. You agree to use the Service only on websites you own, operate, or are authorized to test, and not to use it to overload, probe, or interfere with systems you do not control. You must not resell, sublicense, or circumvent license enforcement, nor reverse engineer the Service except as permitted by law.

5. Plans, licenses and device activation

The Service offers a free tier and paid subscriptions. Paid plans are activated by a license key bound to a limited number of devices (currently: Pro 3, Agency 10). Licenses are personal to the purchasing organization and may not be shared publicly. We may revalidate a license periodically; if a license is canceled, expired or used beyond its device limit, access to paid features may be suspended.

6. Subscriptions, billing and renewal

Paid subscriptions are billed in advance on a recurring basis (monthly or annually) through Lemon Squeezy, which acts as our merchant of record and handles payments, invoices and applicable taxes. Subscriptions renew automatically until canceled. You can cancel at any time through the customer portal link in your license email or by contacting us; cancellation stops future charges and access continues until the end of the paid period. If a renewal payment fails, we may retry the charge and suspend access to paid features until payment succeeds. Prices exclude taxes unless stated; Lemon Squeezy calculates and collects applicable taxes at checkout. We may change prices with notice before your next renewal.

7. Refunds

If you are not satisfied, contact support@adasafecheck.com within 14 days of a charge and we will refund it in full. Refunds are issued to the original payment method within 10 business days of approval. If you cancel a subscription, you keep access until the end of the period you have paid for; a renewal charge can be refunded within 14 days if you have not substantially used paid features since the renewal. 8. Your content and permissions

You retain all rights to your websites, pages and content. Scans performed by the extension run locally in your browser; we do not receive the page content or findings. When you submit a URL to the hosted check, you grant us permission to access that public URL for the purpose of performing the check; submitted URLs and scan output may be logged for abuse prevention, security and quality purposes.

9. Intellectual property

The Service, including the ADA SafeCheck name, logo, software, report templates and this website, is owned by ADA Safe Check and protected by applicable law. Reports you generate may be used freely within your organization and shared with your clients, advisors and legal counsel. Third-party components (including axe-core and jsPDF) are used under their respective open-source licenses.

10. Third-party services

We rely on third parties including Cloudflare (hosting and infrastructure), Lemon Squeezy (merchant of record and payments) and, optionally, an email provider for license delivery. Their terms and privacy practices apply to their part of the Service. We are not responsible for outages or acts of third parties.

11. Availability and changes to the Service

We aim to keep the Service available but do not guarantee uninterrupted operation. We may modify, add or remove features, and may release features on a preview or beta basis that may change or be withdrawn. We may impose reasonable usage limits to protect the Service from abuse.

12. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will find every accessibility barrier, that any particular finding is complete or current, or that use of the Service will prevent any claim, demand, or legal proceeding.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total aggregate liability arising from or relating to the Service is limited to the greater of the amount you paid us in the twelve months preceding the event giving rise to the claim or $100. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Dispute resolution; arbitration; class-action waiver

Please read this section carefully — it affects your legal rights.

Most concerns can be resolved quickly by contacting support@adasafecheck.com. Before filing a claim, you agree to email us a written description of the dispute and to attempt good-faith resolution for 30 days. If the dispute remains unresolved, either party may bring an individual claim in binding arbitration administered under the Arbitration and Conciliation Act, 1996 (India), with the seat of arbitration in India and proceedings conducted in English. Either party may instead bring an individual claim in a small-claims court of competent jurisdiction, and either party may seek injunctive relief in court to protect intellectual-property rights.

You and we agree that claims must be brought individually, and not as a plaintiff or class member in any class, collective or representative proceeding, and that the arbitrator may not consolidate the claims of more than one person. If this class-action waiver is found unenforceable, the entire arbitration agreement is void. You may opt out of arbitration by emailing support@adasafecheck.com within 30 days of first accepting these Terms, stating that you decline arbitration.

15. Termination

You may stop using the Service at any time by uninstalling the extension and cancelling any subscription. We may suspend or terminate access if these Terms are breached, if required by law, or if the Service is discontinued. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability and dispute resolution — will survive.

16. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to the dispute-resolution terms above, the courts located there have exclusive jurisdiction over any dispute, unless applicable consumer law gives you the right to bring proceedings elsewhere.

17. Electronic communications and notices

You consent to receive communications from us electronically, including emails to the address you provide, and agree that those communications satisfy any legal requirement that they be in writing (E-SIGN Act). Notices to us must be sent to support@adasafecheck.com.

18. Copyright policy (DMCA)

If you believe content available through the Service infringes your copyright, send a notice under the Digital Millennium Copyright Act to support@adasafecheck.com including a description of the work, the allegedly infringing material and its location, your contact information, a good-faith statement of your belief, and a statement under penalty of perjury that you are authorized to act. We will respond promptly to valid notices.

19. Miscellaneous

If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary and the remaining provisions stay in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Service. Export-control and sanctions laws apply to your use of the Service.

20. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by the date below, and continued use of the Service after an update constitutes acceptance of the revised Terms. If you do not agree to a change, stop using the Service and cancel any subscription.
